These terms are NOT applicable for commercial work. Therefore the client can
only use the art for personal purposes.

Terms and Conditions

REFUND/ CANCELATION POLICY

If the initial price of the product has been properly discussed and agreed upon, it will be NON-REFUNDABLE/CHANGED. If the price has already been paid, the only way the client can receive a refund is if there has been little to no progress from NeedyHypocrite.If you requested a Paypal chargeback at any point when you were not allowed to ask for a refund, you would lose all the beforementioned rights to the commissioned piece. I will have the full right to profit further from it in any way. I will decline the chargeback and supply PayPal with our conversations as evidence that I have completed work for you. Furthermore, I will blacklist you for commissioning me again.

The Term of this Agreement (The “Term”) will begin when payment is agreed upon and the method agreed upon by both parties. Payment is paid 100% upfront. Client will submit a written form through former method of communication which is but not limited to, Twitter, Instagram, and Discord, that he/she/they have agreed to aforementioned Terms of Service, The Total Payment, and Additional Fees that NeedyHypocrite sees fit for each project and will abide by all rules that entails below.The Client will be expected to remain patient throughout the process as NeedyHypocrite will send screenshots of the Project to which the Client and NeedyHypocrite has agreed upon.Payment after discussed may be paid prior or after the finished product. However, if the payment has not been paid, all updates will include SmoogieArts’ watermark to ensure an exclusion of plagiarism or thievery.

All intellectual property and related material (the “Intellectual Property”) that is developed or produced under this agreement, will be the property of SmoogieArts. Client may request ownership from SmoogieArts.

Ownership of Intellectual Property

All intellectual property and related material (the “Intellectual Property”) that is developed or produced under this agreement, will be the property of NeedyHypocrite. Client may request ownership from NeedyHypocrite

Indemnification

Except to the extent paid in settlement from any applicable insurance policies, and to the extent permitted by applicable law, each Party agrees to indemnify and hold harmless the other party, and its respective affiliates, officers, agents, employees, and permitted successors and assigns against any and all claims, losses, damages, liabilities, penalties, punitive damages, expenses, reasonable legal fees and costs of any kind or amount whatsoever, which result from or arise out of any act or omission or the indemnifying party, its respective affiliates, officers, agents, employees, and permitted successors and assigns that occurs in connection with this agreement. This indemnification will survive the termination of the agreement.

Severability

In the event that any of the provisions of this agreement are held to be invalid or unenforceable in whole or in part, all other provisions will nevertheless continue to be valid and enforceable with the invalid or unenforceable parts of the severed from the remainder of this agreement.
